FAQ about IOLTA Compliance

If I am a licensed attorney in Massachusetts but my practice is located out of state, and I have no law offices in the state of Massachusetts what should I fill in on my registration statement? 

A

 

You can check off #1 under Attorney's Request for Exemption if you do not maintain a law office in the state of Massachusetts.  In addition next to #3 Specify please write in the state in which your law office is located.  If you have an interest-bearing client funds account in that state, you are not required to fill in the account number on your Massachusetts Registration Statement. 

 

   

 


Q

I am admitted to practice in Massachusetts but do not engage in the private practice of law and do not receive client funds, am I exempt?

A

You are exempt and can check off #1 under Attorney's Request for Exemption and then next to #3 Specify please write "I am in the ________________ [type of business]".

    


Q

I am a new attorney and am looking for a job, but currently do not have one, and have not collected any client funds yet, how should I fill out my registration statement?

A

You can check off #1 under Attorney's Request for Exemption and then next to #3 Specify please write in that you are currently seeking employment, and will open an IOLTA account when you receive client funds. 

Q

My IOLTA Compliance information has changed since I last completed the BBO registration statement, what should I do?

A

You do not need to notify the IOLTA Committee or the BBO when your IOLTA compliance status changes between registrations.  The next time you complete your registration statement simply put in the new information.

When is my BBO registration statement due?

A

The registration statement is due 30 days after the statement billing date on the front of the registration card.

    


Q

How much do I owe for my registration renewal?

A

Your billing amount depends upon the length of your admission in the Massachusetts Bar as of the registration billing statement date found on the front of your card.

My address has changed, what should I do?

A

On the front side lower right corner of your registration statement print your new address or make any corrections to your current address.
